The Director of USCIS, Alejandro Mayorkas, hosted a nearly two hour chat with EB-5 visa stakeholders today in Washington. He was very candid with his responses, entertaining questions from the audience of EB-5 attorneys, Regional Center operators and other EB5 visa service providers.
This was a preface to the EB-5 Quarterly Stakeholders Meeting which will be held tomorrow at 1pm EST and the USCIS panel will discuss issues of concern to the EB-5 visa community. USCIS is specifically interested in receiving topics related to the Form I-912A, Supplement to Form I-924.
Of particular interest in today's talk was the discussion of using "Bridge Financing" and replacing that with EB-5 funds once the adjudication of the I-526 has been approved and the funds released from escrow into the developers account and the mention of allowing the immigrant investor visa program to invest in fund type structures and how that could conform to the agency's requirement of job creation.
Both issues are still being discussed among the policy makers at USCIS, but the very candid engagement by Director Mayorkas to entertain changes to current policy guidance was well received by all in the audience.
